Please take a moment to thoroughly review the following Terms and Conditions, as they outline your responsibilities and our policies regarding the purchase and overnight shipping of live animals. By placing an order, you signify your agreement to these terms.

## 1. General Agreement

By accessing and using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Autumn’s Little Critters reserves the right to modify these terms at any time. Any changes will be effective immediately upon posting on our website. It is your responsibility to review these Terms and Conditions periodically to stay informed of any updates.

## 2. Eligibility

To purchase live animals from Autumn’s Little Critters, you must be at least 18 years of age. By placing an order, you affirm that you meet this age requirement and possess the legal capacity to enter into a binding agreement.

## 3. Shipping Policy

### 3.1. Overnight Shipping Requirement

To ensure the welfare and safety of our live animals, all purchases must be shipped via overnight delivery. This requirement minimizes transit time and reduces stress and potential harm to the animals.

### 3.2. Shipping Costs

Customers are responsible for all costs associated with overnight shipping. Shipping charges will be calculated at checkout based on the destination, package size, and weight. These costs are non-negotiable and are separate from the purchase price of the animals.

### 3.3. Delivery Schedule

Shipping Days: Autumn’s Little Critters ships live animals exclusively on Tuesdays. Orders must be placed by the cut-off time on the preceding Monday to ensure same-week shipping. Orders placed after this cut-off time will be processed and shipped the following Tuesday.

Weekend Transit: This shipping schedule is designed to prevent live animals from being held in transit over weekends, which could jeopardize their health and well-being.

### 3.4. Weather Conditions

In the event of extreme weather conditions that may pose a risk to the animals, Autumn’s Little Critters reserves the right to delay shipping. Customers will be promptly notified of any such delays, and shipping will resume once conditions are deemed safe.

## 4. Order Confirmation

Upon the successful placement of an order, you will receive a confirmation email detailing your purchase and shipping information. It is crucial to review this email carefully to ensure that all information is accurate. Any discrepanciesshould be reported to us immediately for resolution. Failure to notify us of any inaccuracies may result in shipping delays or issues upon delivery.

## 5. Live Arrival Guarantee

### 5.1. Guarantee Conditions

Autumn’s Little Critters offers a Live Arrival Guarantee under specific conditions:

- Recipient Availability: The guarantee is valid only if someone is present to receive the package on the first delivery attempt. It is the customer’s responsibility to ensure that the delivery address is correct and that someone will be there to accept the package.

- Notification of Issues: In the unfortunate event of a Dead on Arrival (DOA) situation, customers must contact us within 4 hours of delivery. A photographic proof of the deceased animal must accompany your notification for verification purposes. 

### 5.2. Exclusions

Our Live Arrival Guarantee does not cover:

- Delays caused by the shipping carrier.

- Incorrect shipping information provided by the customer.

- Packages that are left unattended after delivery.

- Animals that are not cared for properly upon arrival.

## 6. Customer Responsibilities

### 6.1. Legal Requirements

Customers are responsible for ensuring that the purchase and delivery of live animals comply with all local, state, and federal laws and regulations. It is the customer’s responsibility to research and understand these regulations before placing an order.

### 6.2. Animal Care

Upon receipt, customers must provide appropriate care and habitat for the animals. Autumn’s Little Critters provides care guides for each species, which should be followed to ensure the health and well-being of your new pet. Failure to provide adequate care may result in health issues for the animal, for which Autumn’s Little Critters cannot be held responsible.

## 7. Returns and Refunds

Due to the nature of live animal sales, all sales are final. Autumn’s Little Critters does not accept returns or offer refunds, except under the conditions outlined in our Live Arrival Guarantee. 

## 8. Limitation of Liability

To the fullest extent permitted by law, Autumn’s Little Critters shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the purchase or shipping of live animals. Our liability is limited to the amount paid for the live animals in question.

## 9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which Autumn’s Little Critters is based, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the appropriate courts located within that state.
